1. Acceptance

By using Quakey XR you confirm that you are at least 13 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, do not use the Platform.

2. Your Account

You're responsible for keeping your account secure and for activity that happens under it. Give us accurate information when you sign up, and don't share or hand off your account to someone else.

3. Content You Create

What you build is yours. You retain full ownership of the original content you upload and the Projects you create. By uploading content, you grant Quakey XR a limited, non-exclusive license to store, display, and deliver that content as necessary to run the Platform and render your experiences - nothing more. You're responsible for making sure you have the rights to anything you upload.

4. Prohibited Content

Quakey XR is built for creators, artists, businesses, and educators to build something they're proud of. To protect that community, the following is not permitted, under any circumstances, with no exceptions:

• Explicit pornographic content depicting sexual acts. Adult-oriented businesses, artistic nudity, body painting, and mature creative work are permitted for accounts that appropriately flag their projects as Mature Content (18+). Quakey XR reserves the right to determine what constitutes explicit content in violation of this policy.

• Any content that sexually exploits or depicts minors in any way (CSAM). This is reported immediately to the National Center for Missing and Exploited Children (NCMEC) and law enforcement. There is no warning, no grace period, and no appeal.

• Hate speech, racist imagery, or content designed to dehumanize individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin

• Content intended to harass, threaten, stalk, or intimidate any individual

• Deepfakes or manipulated media created to deceive, defame, or harm real people without their consent

• Malware, phishing pages, or content designed to compromise the security of others

• Content that infringes on the intellectual property or trademarks of others

• Any content that violates applicable local, national, or international law

Violating this section results in immediate account termination. We do not negotiate, we do not make exceptions, and we do not reinstate accounts terminated for CSAM violations - not under any circumstances.

5. Subscriptions and Billing

Quakey XR offers free and paid subscription tiers, billed on a recurring basis through Stripe. Subscription fees are non-refundable except where required by law. If a payment fails, your account will be downgraded to the Free tier and all published experiences will be unpublished until payment is resolved. We'll give you reasonable notice before any pricing changes.

6. Storage

Each tier includes a storage allocation for your uploaded assets. If you hit your limit, you'll need to upgrade or clear out files before uploading more. Current limits are listed on our Pricing page.

7. Platform Intellectual Property

The Quakey XR platform itself - the builder interface, the node system, the runtime engine, the visual design, and the branding - belongs to Entity Creative Solutions and is protected by applicable intellectual property law. You may not copy, reverse engineer, resell, or redistribute the Platform itself.

8. Termination

We reserve the right to suspend or terminate an account at any time for violating these Terms. You can delete your account whenever you want. Once an account is terminated, Projects and uploaded assets may be permanently deleted from our servers.

9. Disclaimer of Warranties

Quakey XR is a new platform built on emerging augmented reality technology. As with any platform pushing new capabilities, you may encounter bugs, performance issues, or features still being refined as we continue to improve the Platform. We work to resolve issues quickly, but the Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Platform will be available at all times, free of errors, or suitable for any particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, Entity Creative Solutions and its operators are not liable for indirect, incidental, special, or consequential damages arising from your use of or inability to use the Platform, including loss of data, loss of revenue, or business interruption.

11. Copyright / DMCA

Believe something on the Platform infringes your copyright? Email us at info@quakeyxr.com with a description of the content and proof of ownership. We'll review it and respond in accordance with the Digital Millennium Copyright Act.

12. Changes to These Terms

We may update these Terms as the Platform grows. If we make a significant change, we'll notify you through the Platform. Continued use after changes take effect means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Connecticut. Any disputes are resolved in the courts of Connecticut.
